What is bankruptcy?
Bankruptcy is a legal proceeding in federal court. The U.S. Constitution guarantees your right to file bankruptcy. Your bankruptcy filing stops all of your creditors’ calls and letters. You and your attorney will set up a bankruptcy plan, which could reduce the amounts you must pay on your debts. A plan may also set up a schedule for payment to pay those debts over time.

What about my home or mobile home?
You can stop a pending foreclosure sale. Bankruptcy doesn’t wipe out everything you owe, but it will erase most of your debts and give you time to catch up on the debts you want to pay. A bankruptcy also stops utility shut-offs.
Will it stop the phone calls?
Yes! It is illegal for creditors to contact you after you’ve filed for bankruptcy. If your creditors do not follow the law, the Court may fine them. I will show you how to track these violations and make them stop. Keep track on this Collections Communications Log.
Should I be worried about repossession of my car or other properties?
In most cases filing bankruptcy assures you will be able keep your property. If your car has already been repossessed, you may be able to require the creditor to return it.
Will bankruptcy give me relief from these outrageous interest rates and service fees being charge by the credit card companies?
Once you file for bankruptcy your creditors must stop trying to collect debts from you. Fees and interest rates can no longer be applied to your credit card balances. While a bankruptcy filing may significantly reduce or eliminate the debt, I help you protect your fresh start by suing creditors who choose to ignore the Bankruptcy Court’s discharge order.
